Introduction

These Terms of Use (“Terms”) govern your access to and use of Ability Shell websites (including abilityshell.com) and mobile applications published by Ability Shell Ltd (“Apps”). By using our site or installing or using our Apps, you agree to these Terms.

1. Who We Are

Ability Shell Ltd is an independent studio building digital tools and experiences. You can contact us at info@abilityshell.com.

2. Licence and Permitted Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to install and use our Apps on devices you own or control, solely for your personal, non-commercial use. You agree not to copy, modify, adapt, translate or create derivative works of our Apps; reverse-engineer, decompile or attempt to extract the source code (except where permitted by law); circumvent or disable any security or technical features; or use our Apps for any illegal or unauthorised purpose.

3. Intellectual Property

All rights, title and interest in and to our Apps, website, designs, puzzles, graphics, text and other content are owned by Ability Shell Ltd or our licensors. You receive no ownership rights by using the Apps or website.

4. In-App Purchases and Payments

Some Apps may offer optional paid features or upgrades (“In-App Purchases”). All payments are processed by Apple (for iOS/iPadOS through the App Store) or Google (for Android through Google Play). We do not store your payment card details. Refunds are handled in accordance with the policies of Apple or Google, as applicable. Please contact the relevant store directly for refund requests.

5. Data and Privacy

Our use of personal information is described in our Privacy Policy, which forms part of these Terms. By using the Apps or website, you also agree to the Privacy Policy.

6. Availability and Changes

We aim to keep our Apps stable and available, but we do not guarantee uninterrupted or error-free operation, compatibility with all devices or operating system versions, or that any particular feature will remain available. We may modify, update, or discontinue any App or feature at any time, for any reason.

7. User Feedback

If you choose to send us feedback, ideas or suggestions, you agree that we may use them to improve our products without any obligation to compensate you. We will not publicly associate your name with feedback without your permission.

8. Disclaimer of Warranties

To the maximum extent permitted by law, our Apps and website are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Ability Shell Ltd and its directors, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, loss of profits or business interruption, arising out of or in connection with your use of our Apps or website. Where liability cannot be excluded, it will be limited to the amount you paid for the relevant App (if any).

10. Third-Party Links and Services

Our Apps or website may contain links to third-party websites or use third-party services. We are not responsible for the content, policies or practices of those third parties.

11. Termination

We may suspend or terminate your access to our Apps or website if we reasonably believe you have violated these Terms or used our products in a harmful or unlawful way. You may stop using our Apps at any time by uninstalling them.

12. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. If a court finds any part of these Terms invalid or unenforceable, the remaining provisions will continue in full force and effect.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top. By continuing to use our Apps or website after changes take effect, you accept the revised Terms.
